Who is entitled to file a builders’ lien? Is the estate and interest of Governments lienable? What are the proper times within which to file a builders’ lien? What is a prevenient arrangement? Can a change of title defeat a claim for lien? How do the major lien fund and minor lien fund work? If they don’t work under your contracts, how can you redraw your contracts to minimize the possibility of builders’ liens being filed, but still protecting your interests as the owner or contractor? Are arbitration clauses enforceable when builders’ liens are filed? How does one remove a builders’ lien from a certificate or title? Are there limited trust provisions in Alberta and how does one protect one’s self from ensuring that one can properly make progress payments without bearing double jeopardy if builders’ liens come on title to the property?

These are the questions, the answers of which will be provided at this seminar, which are extremely important to all members of the construction industry.

This session will cover the rights and obligations of all of those involved in the tendering process. What are the obligations of those parties who submit tenders and what are the obligations of those parties who call for tenders? Can the person calling for tenders accept a non-compliant tender? Does a tender have to have all the i’s dotted and the t’s crossed to be a compliant tender or is a substantially compliant tender sufficient? What is a substantially compliant tender? What damages is the tenderer liable for who refuses to ender into Contract B? Is the tender-calling authority responsible for damages and, if so, how much if the tender-calling authority wrongfully awards a tender? Can a tender-calling authority bid shop after tenders close? Does the privilege clause (the lowest or any tender will necessarily be accepted) give the tender-calling authority any rights? Can that tender-calling authority amend a tenderer’s tender after tenders close if the tender package permits the tender-calling authority that right?

These are all questions of interest, not only to the construction industry, but to any party involved in the tender process. The tender process of course includes requests for proposals and thus can cover a wide range of commercial transactions.

Kristin Moore

Biography: For over ten years Kristin Moore has been involved in Modular Architectural Interiors. She is one of the founding leaders of DIRTT Environmental Solutions, helping to develop the company’s environmental operations and philosophy. Previous to DIRTT, she led dealer and training departments at SMED International/Haworth Inc. Kristin is a working advocate of sustainable initiatives as it relates to building green interiors.  She is Environmental Lead at DIRTT, involved in helping navigate clients, architects, and designers toward environmentally sustainable solutions, without compromising the design aesthetic or the client’s bottom-line. To demonstrate an apples-to-apples comparison of conventional interior construction to modular interior construction, Kristin uses a data tool that not only takes into account the financial cost of each approach, but also the environmental cost. The numbers aren’t based on some generic imaginary space. She uses the client’s precise space in their precise location. The data tool, called ICEberg®, is a finalist in the 2007 CoreNet Global Innovation Award.   Kristin is a LEED® Accredited Professional (since 2004), and has been involved in several LEED projects across Canada and the United States including the new Exelon Tower in Chicago (LEED Platinum) and Johnson County in Olathe, Kansas (LEED Gold).

Certified as LEED Silver in 2003, the Canmore Civic Centre is one of Alberta’s frontrunners in terms of green building design. Having been in operation for a few years now, it is possible to look at its performance in terms of building maintenance, energy efficiency, sustainability, and community and environmental benefits. In a panel presentation, representatives from the Town of Canmore will present a operational and building maintenance review as well as overall benefits gained while Marshall Tittemore Architects will share lessons learned in terms of considerations for long-term performance and sustainability.

There have been many advances in light source technologies in the last few years but without a delivery system; the luminaire (or fixture as it is most often called); these new technologies cannot be used. These luminaires need to perform properly, which means getting light where it is needed, and look good by either blending into the architecture or acting as an architectural element. Then there is the whole issue of control: switching and dimming with these technologies. This session will examine the important aspects of luminaires and controls that must be considered when using these new light sources and technologies.

The Canada Green Building Council LEED CI rating system puts much emphasis toward lighting, it can be used as a benchmark for all your office lighting projects. Guidelines for quality lighting coupled with high performance luminaire systems help designers create more productive and energy efficient spaces for the people who work in them. This seminar describes methods used to price construction claims and the cost analysis of these methods. It includes discussion of various methods and the considerations to be made for different types of claims. The presentation also includes content on the analysis of damages for different types of costs, such as labor, equipment, field office overhead, etc. The seminar concludes with a case study that involves many of these specific issues.

At the end of this seminar the learner will:

• Be familiar with some of the most prevalent methods of pricing construction claims;
• Understand the information, including specific documents and reports, that is involved in analyzin a contractor’s costs and damages
